Allen, sorry to read about your circumstance. If it's any help I had a similar experience with a trader who sold my Porsche way back in 1989. He stalled on the payment several weeks after the car was sold. After a lot of pressure he sent me a company cheque for the full amount. A few days later it bounced. I went to the garage to find it closed down. While peering through the window a former employee who just happened to arrive, told me he was looking to acquire any assets he could from the garage in lieu of non payment of his wages. He also told me the fella had Canadian status and had done a runner back to Canada.
Very, very fortunately the ex employee remembered where my car had gone (to another trader for debt payment)

I then visited this second trader who had my car on his forecourt.

Following an interesting conversation, he refused to let me have the car back because he'd just invested in having it repainted.

I called the Police, who actually turned up back then & was handed the car back.

My advice is act NOW, you cannot image what twist or turn may take place by tomorrow.

I remain confident that this will be sorted fairly soon. The dealer in question has been in the business a long time and I believe would like that to continue. He is aware that further delay will lead to further negative impact on his prospects.

The dealer in question has been spinning tales for a long time.

I was warned never to do business with him more than ten years ago.

He will pay you when he pleases... if he pays you at all.

Contact your lawyers tomorrow morning and get the process under way.

Dealer in question has a social media account, showing last week a pretty high value car sold and off to its new owner. If we imagine some cash arrived for that, the question is how to be first in line for that cash.

I suspect the noisiest hinge gets the oil.

Quite some years ago I bought three cars in an hour from the dealer in question......

356 Speedster - price agreed for car under restoration £40,000 - to be delivered, with restoration completed within three months
911 2.7RS - price agreed £40,000 - being restored as Speedster with delivery in three months
996 C2 - price agreed £36,000 - with wheels changed to Turbo Alloys with new tyres ( as all tyres on the car were bald)

I paid in full for all the cars and the following week the 996 was delivered - the wheels hadn't been changed and it had four bald tyres - basically he had completely ignored the agreement we had made. I took the car to a local tyre specialist who confirmed I would have lost my licence with three points for every bald tyre ( quite aside from the danger the condition presented ) - It took me a month and much pestering for our dealer friend to pay me for the new tyres I had to buy !

The 2.7RS was delivered about three months later with bits of trim hanging off and many obvious issues with it's condition. I had it taken to a reputable specialist who examined it and came up with a list of 42 items they had found wrong with it ! I told our dealer friend that I wanted my money back as the car was not fit for purpose - it took me two months to get my money back.

356 Speedster - after a catalogue of excuses and seven months wait when there was no discernible progress on the car and absolutely no sign of it being delivered, I had to fight for a further two months to get my forty grand back.

Believe me this guy does not give a shite about you !

Bizarrely I was called at the weekend by a chap who had heard from a friend that I was looking to sell one of my non-Porsche cars, we chatted a while about life in general, bikes and cars. The caller told me which cars he had and asked what I had. I mentioned that I had a number of Porsches and completely out of the blue ( absolutely no prompting by myself) said "you've never dealt with (said dealer) have you ? " - I said I had in the distant past - "Why ? "
The caller then went onto tell me how he'd sold a car on SOR through "said dealer" a couple of years ago - and guess what ??? yes he didn't get paid what was due for his car, so he waited when it was promised and the money never arrived, so he asked again and there was another excuse, and another and another, then he said it was promised on numerous occasions and never arrived - so he went to visit "said dealer " and took a friend with him who was "persuasive" and finally five months after the car was sold managed to extract his money from "said dealer"
I thought this was an unbelievable coincidence and pointed him in the direction of this thread so he could read about someone having an identical experience

I repeat - THIS GUY DOES NOT GIVE A shite ABOUT YOU !

I could go on and tell you about my friend who lives in Europe who bought a 911 from "said dealer" over the phone - minor problem when the car was delivered and chassis number checked - it wasn't a 911 - it was a 912 with a 911 engine fitted - see above re sending someone to visit to persuade "said dealer" to return his money ( after the obligatory three months of broken promises ! )

I'm just buying another 911 from a dealer in the South and was on the phone to him this evening, I mentioned this thread and he told me that he "already knew about it, as does almost every dealer in the Porsche related industry " - it seems to be a fairly open secret that "said dealer" behaves in this way on a very regular basis - I reckon the more complacent you are, the further down the queue to be paid you will fall !

Your call as to what approach you take but look back to your first post last week -there doesn't seem that there's been much progress since that time !

Having been in your situation many times over the past years in the building trade if he goes into liquidation you will be lucky to get a penny in the pound as the reviue then the banks get first charge on any money you must either get the car back or insist payment is made to day or you have him decalered insolvent this usual make them pay up quickly if he doesn’t it usually indicates that he is insolvent and it could be a matter of hours
I would also check to see if he has set up any new company’s up or has any already as he may moving things over for when goes bust

I feel for you Flat 6.

This is a bad situation for everyone, except the specialist. Flat 6 trying to get his money out of the 'unnamed specialist' but also the next unsuspecting buyer or seller who hands over their pride and joy or hard earned cash and becomes the next person to be potentially left out of pocket.

If you shame the dealer there's a chance they'll get less business and you don't get your money. If you don't shame them and get your money it's the next persons problem.

Puts me off selling SOR (or buying a car on SOR). I'd prefer to do a private sale and get a garage I trust to ensure the car is straight.

The question is why are you waiting?

My guess is that they don't have the money as they have already spent it. As others have mentioned the dealer has now got the shadow of the tax accrued on the sale of the car as a whole rather than just the commission. So a bad situation is just getting worse.
Payday is at the end of the month and rather than pay a creditor who has waited since July he will pay those around him.

Surely something is underway confidentially by now, and hence the silence.
Hope he has got the legal boys and girls in there by now.

Do you name and shame after payment is fully made if legally sound?
I have no idea who the dealer is, not really bothered personally, but it is the principle that he can or will get away.

From what I’ve seen on another forum, what we have is a decent guy being put on the drip by the worst of what the motor trade can produce. I suspect Al will be waiting quite a while before he gets anywhere near the full sum owed to him. The stories on here and IB show his history of failing to stump up on time.

This guy will string this out for as long as he likes, frankly I think the best action is to go legal and make yourself his priority and not be the easily palmed off, far away Ulsterman.

I’ve kept quiet but this needs a conclusion and you wouldn’t believe how many stories I’ve been sent about his underhand dealings - seems time is finally catching up on him
