I like that DDK could be sued for defamation and loss of revenue for discussing this if we use the name in a public domain. But it's ok for the dealer to hold the commission plus sale revenue for month's and just shrug as though this is just part of the game we play.
Even better as the dealer is to stay schtum hoping it blows over before Winter, a notoriously quiet season in the Classic car market. Genius move there buddy.

Not so clever. As the injured party I am allowed to tell my story with no fear of defamation. Particularly when the case is so clear cut. A.

The good guys always seem to lose out in time, money, hassle, health.

What is to stop you arriving with the police and recovering your car and letting the ‘buyer’ sort out the issue with the dealer rather than you having to deal with all this sh!t. Or, is the payment of 25% deposit to you another clever little ploy to stop that happening?

In a similar vein, what is to stop the DDK collective arriving for an impromptu get together, complete with bunting, music and balloons and someone with a megaphone shouting "give Al back his money"? Perhaps Classic Porsche (or similar might even like to cover the event in its next issue? You could title it "Dont Fuch with the DDK"

I once held something hostage in order to get paid. A heard a non-paying client had bought a painting at auction. I went in to collect it, posing as third party courier. Amazingly the auction house released it to me. What a pleasure it was to explain all this to the painting’s new owner, along with a few home truths and a photo of the painting on my study wall.

I wouldn’t have got involved if it had not been for his attitude. Didn’t take much longer to get paid.

And does the SOR agreement say that the car is yours until payment received in full? In which case this also highlights a problem for the buyer (who in other circumstances could be any of us...)

Seems plenty of DDKers now know who this is.
DDK-ers tend to buy, own, and sell the kind of car this dealer works with.
Hmmmm.... doesn't seem like a great business plan to me.

It is getting late on the day, presumably no payment yet.

I doubt the Police would go to the premises with you, you need a crime to have actually happened to get that.

As 210 says, it is the normal law-abiding people that get the grief, but if someone lives on the other side of the law then they seem almost protected. Innocent until proven guilty.

I remember reading, many years ago, (but not in this country) court reports of people being charged with the offence of 'Converting money to his own use.' Guilt was easily proved, and conviction and sentencing quickly followed.

This seems to be the same situation - the dealer has accepted funds from a purchaser, but has used those same funds to prop up his ailing business.

Perhaps the law is different in the UK?
