Or he could be going through personal issues, like an expensive divorce which in these days of ‘no fault separation’ can be crippling especially for the self employed whose income is irregular. Or one of his kids might be seriously ill in hospital. There could be any number of reasons and unless we know the full story from both sides it’s easy to jump to a conclusion.

Not saying everything is all ok here, he should pay up because of the wrongful withholding of anyone’s money when the agreement has been made is totally unlawful and should be vigorously pursued. I agree with everyone that tomorrow should be deadline day.

I have no doubt that the dealer is going through cash flow problems. I work with small businesses for a living and I am acutely aware of how easy it is for a company to get into diffs. I'd say the guy needs to find c£45k a month just to keep the lights on, not that easy selling classics and no doubt the reason why there are few businesses of any scale in the sector.

It is this understanding that has encouraged my patience to date but enough is enough. The guy has plenty of stock but I expect just doesn't want to have to sell it at cost or loss to fund his business so has decided to use SOR money instead. My visit to him recently was supposed to be the end of the matter. He was very apologetic and left me with the feeling that it would indeed be sorted within days. Unfortunately he then decided not to keep his promises made to my face and with a handshake so here we are. Shameful.

Anyway, I have a pretty heavyweight legal firm in Leeds, DWF, straining at the bit to get stuck in and earn some fees. If they get hold of this they'll be after the outstanding debt plus interest and costs so I'm sure the dealer in question will want to avoid that by paying tomorrow.

And then of course there is also the possibility that I'll go all impolite and start naming all over the several forums I'm on. Haven't put this up on PCGB yet, for example.

I'm really not impressed by this - it's shabby behaviour, dishonest practice and frankly the trader should be ashamed of themselves. We know who they are.

If you can't be trusted to act as a middleman, you shouldn't be in business. That is not your money. It's not a cash-flow issue, I'm assuming you got full payment from the buyer before parting with the car? The stress you've caused. Are you sleeping well at night?

Just do the right thing. But understand that word gets around....

Wow are we not all losing site of one thing here.....dealer takes car on as SOR, sells car, owner gets paid less agreed commission sent to owner of car sold within normal banking transaction times, business closed with 2 happy customers.
What more need to be said.
No one should use other peoples money to fund or keep business afloat as each transaction should be treated exactly as that unless investing or by previous agreement.
my issue with this is that people are now relying on this type of service to sell cars as worried of being scammed on net.
Check ratio of private to trade car sales in market.
So if this is new way fwd what, who and where do people sell/trade with confidance.

I must admit, I wouldn't have been so patient. By the sounds of it, you had an open and shut agreement at the beginning.

The dealer is getting a commission - not a loan also. No business should do that, however desperate.

So hopefully you got your money. We are all watching!

I’ll be honest if you don’t get your money today and given some insights I’ve had then I would make sure a lot of noise is made about this

One of their own cars has gone out for delivery today as publicised by themselves so guessing they’ve had some cash arrive in the last few days

Not on this sort of behaviour

I think the dealer needs to be named (unless it already has) so that no one gives them a car to sell. Looks like they have serious cash flow problems.

They will be named if the money doesn't get paid today as agreed- subject to legal guidance

I'm not into name and shaming threads however I have enough information provided to be confident this is very clear cut and quite frankly not acceptable at all.

I have also had many PMs asking for the dealers name as people using SOR services or considering them are naturally concerned. I will happily provide anybody who asks the details via PM

I have had a discussion with this dealer and have agreed to back off temporarily while he sorts his sh1t out at his end. He promises the money today or tomorrow.

So I will be going quiet for a few days and I would ask you to do the same.

Some of you will think me a mug. Maybe I am.

I'll be back with a report asap.

I've had 6 requests today for the name from people who are looking into SOR and in private I will reveal who it is to protect anybody else from being on the receiving end of this type of activity
