Its a sorry state of affairs. I know Dave Whelan very well (over 20 years) he's a straight as the day is long and President of the Porsche Club Ireland. He also a good guy and i've raced with him in the Porsche Open Series here in Ireland and also in PCGB Open series in the UK.
What this points out is that we all need to do our due diligence when buying cars and not to get accidentally caught out and in the situation Mark and Dave now see themselves in.
I too want to see this resolved amicably - one were no one losses out.

Wow. It would be interesting to know how someone managed to get a new V5 for it, or did it still have the old uk plates?

I guess if it still had the plates and nobody had told the UK police a car with those plates had been stolen in Ireland then it would be straightforward. Makes you think, though. Scary...

I bought the a couple of years ago on Ebay , and applied for the V5 as normal , and had it returned in my name - I had no idea of ANY issues with the car.
I have PM'ed Dave , so hopefully some solution will be forthcoming.

I just saw Marks PM to me here and I've replied. It looks like we will try to sort the matter ourselves , he bought it in good faith despite the fact there was no V5. As Keith said , the car was brought into Ireland many years ago, rallied here , then raced by me. He bought it off ebay from a Kieron Woods in Maghera in Northern Ireland.

I've just sent Mark a lenghty email and hopefully we can resolve the matter ourselves. I would hope that if that happens then we can fill in the details to fellow DDK members and Forum users afterwards,, there are certainly lessons to be learned for all.

Late to this story but Dave had told me about this car several years ago - I am delighted it has resurfaced , and can only add that knowing Dave well , the ultimate resolution of this will be absolutely fair and reasonable

I think this thread should be locked and/or moved to members area. No good will come of ill informed or idle chat. I sincerely hope this works out ok for all involved, but the story should be told after it is sorted out. Boring i know but....

Update:
I met with Mark last week and bought my shell back from him. It might seem a little strange / mad but had we went legal it would be us that suffered , not them who are in the links of the chain between us. I'm happy , as far as can be expected and I found Mark a gentleman to deal with and fair. I'm sure he will be along here very soon and then the Mods can lock the thread.

Sounds like a good resolution, well done. But a thought occurs to me. If the car was insured and the insurance paid out on it, do they not have an interest in it?

Yes the insurers do, assuming a claim was made....it belongs to them...

It was never insured, it was a race car. I was at a loss for the car.
